Step 6: Moving into My New Home

Finally, the time has come. After a long period of searching or building, the big day is here at last.

Deal with Defects Properly

It's almost inevitable that in the first week after moving into your new home you will discover one or two faults. Legally speaking, a defect arises if the architectural planning, or the construction or fitting works have been carried out faultily or negligently. Therefore, a patio drain that doesn't work and a wall painted in the wrong color are both considered to be construction defects.

  • Legal regulations:You have a guarantee claim for work carried out by tradesmen. New builds, repairs and fittings in and around the building are immovable assets in the eyes of the law. The guarantee period for these lasts five years.
  • SIA Standard No. 118:In practice, many trade contracts refer to SIA Standard No. 118, which limits the guarantee period to two years.

In both cases the rule applies that completed works must be accepted by the principal. If the work is defective from the outset, you must grant the tradesman a grace period for correcting the problems. Depending on the seriousness of the defect, you can insist on a price reduction or even completely withdraw from the contract.

Tax Situation for Owners of Real Estate

Owning real estate changes your tax burden.

  • New increase in income: imputed rental value (notional rent determined for tax purposes)
  • New reduction in income: any indirect repayments via 3rd pillar
  • New deductions: mortgage interest, maintenance expenses, investments for preserving value (annual fixed amount or against actual proven costs)

Value-increasing investments (extensions/conversions) can be offset for tax purposes only when the property is sold.
